Highlights: PA PUC Public Session of October 11, 2007

At the October 11, 2007 Public Meeting of the Pennsylvania Public Utility Commission (“Commission”), the Commissioners adopted Staff’s recommendations for action by a vote of 4-0 on all items listed on the Main Agenda and Carry-In Agenda, except as reflected herein below under the respective Commission agenda headings.  Review of particular items addressed by the Commissioners at this Public Meeting which may be of interest are also addressed under the respective Commission agenda headings below.  The next regular Public Meeting is tentatively scheduled for Thursday, October 25, 2007 at 10:00 a.m.  The minutes of the Public Meeting of September 13, 2007 were unanimously approved without modification.

Bureau of Transportation and Safety

  • Pennsylvania Transit Company, LLC, TSM-0199*,  A-00123331.  Application of, Philadelphia City and County, for the right to begin to transport, as a common carrier by motor vehicle, persons, in paratransit service.  Staff recommends that the Commission adopt the proposed tentative order denying the application.  This matter was postponed until Public Meeting of October 25, 2007. 
  • Henry Lee Hill, t/a One Man One Van Passenger Service, TSM-0227*, A-00123729Application of East Stroudsburg, Monroe County, for the for the right to begin to transport, as a common carrier, by motor vehicle, persons in paratransit service.  Staff recommends that the Commission adopt the proposed order approving the application, as amended.  This matter was postponed until Public Meeting of October 25, 2007.
  • Cadden Bros. Moving & Storage, Inc., TSM-0228*,  A-00123871.  Application of, for the right to transport, as a common carrier, by motor vehicle, household goods in use, which is to be a transfer of all the rights authorized under the certificate issued at A-00099165, to James D. Cadden, t/d/b/a Cadden’s Moving & Storage.  Staff recommends that the Commission adopt the proposed order approving the transfer application.  Motion of Commissioner Christy moving that the Application be approved, in addition to customer requirements regarding the submission of proof of insurance and a tariff, the Applicant be required to file proof that the tax debt owed to the Pennsylvania Department of Revenue by Transferor has been paid, upon compliance with requirements a certificate shall be issued to the  Applicant, and the certificate granted to the Transferor at A-00099165 shall be canceled and the record marked closed and that the Bureau of Transportation and Safety prepare the necessary Order consistent with this Motion.  Vote of 4-0 with no further discussion.

  • All matters approved as submitted.

Office of Special Assistants

  • Shryock Brothers, Inc. v. Uwchlan Township, OSA-0215*, C-20066648.  A five count Formal Complaint was filed July 13, 2006 by Shryock.  By Initial Decision issued May 2, 2007, ALJ Melillo granted the Shryock Motion for Partial Summary Judgment addressed to Counts I and II of the Formal Complaint and denied the Township Cross-Motion addressed to all counts.  Exceptions and Replies were filed by the Parties. The Law Bureau Prosecutory Staff filed Replies to Exceptions.  Staff recommends that the Commission reverse in part the Initial Decision on Counts I and II of the Formal Complaint, consistent with the proposed Opinion and Order.  This matter was postponed until Public Meeting of October 25, 2007.
  • Verizon Pennsylvania Inc. and NEP Cellcorp, Inc., d/b/a NEP Wireless, OSA-0224*, A-311419F7000.  Joint Petition filed on August 24, 2007, for Approval of the Adoption of a Wireless Interconnection Agreement.  No Comments have been received.  Staff recommends that the Commission adopt the proposed Opinion and Order granting the Joint Petition.  Vote of 4-0 with no discussion.
  • Verizon North Inc. and NEP Cellcorp, Inc. d/b/a NEP Wireless, OSA-0225*, A-311419F7001.  Joint Petition for the Approval of the Adoption of a Wireless Interconnection Agreement Under Section 252(e) of the Telecommunications Act of 1996.  Staff recommends that the Joint Petition be granted, consistent with the proposed Opinion and Order.  Vote of 4-0 with no discussion.
  • Lackawaxen Telecommunications Services, Inc. and Sprint Communications Company, L.P., OSA-0229*, A-311700F7040.  Joint Petition for Approval of an Interconnection Agreement Under Section 252(e) of the Telecommunications Act of 1996.  Staff recommends that the Joint Petition be granted, consistent with the proposed Opinion and Order.  Vote of 4-0 with no discussion.

 Bureau of Fixed Utility Services

  • Blue Ridge Digital Phone Company, FUS-0495*, A-311397, A-311397F0002, A-311397F0002AMA, A-311397F0002AMB, A-311397F0002AMC.  Application filed December 7, 2005 for approval to offer, render, furnish, or supply telecommunication services as a Competitive Local Exchange Carrier in the service areas of Verizon Pennsylvania Inc., Verizon North Inc., Palmerton Telephone Company, Windstream Pennsylvania Inc., and Frontier Commonwealth Telephone Company f/k/a Commonwealth Telephone Company and also as a Reseller Interexchange Carrier throughout the Commonwealth of Pennsylvania.  Staff recommends that the Commission adopt the proposed Order.  Vote of 4-0 with no discussion.
  • Aqua Pennsylvania, Inc., FUS-0848, A-210104F0083.  Application filed for approval to begin to offer, render, furnish, or supply water service to the public in an additional portion of East Marlborough Township, Chester County, Pennsylvania.  Staff recommends that the Commission adopt the proposed Order.  Vote of 4-0 with no discussion.
  • Canada Inc., BCE Inc., and BCE Nexxia Corporation, FUS-1363*, A-311371F0002.  Joint Application filed July 31, 2007, by 6796508 for approval of an indirect transfer of control of BCE Nexxia Corporation from BCE Inc. to 6796508 Canada Inc.  Staff recommends that the Commission adopt the proposed Order.  This matter was postponed until Public Meeting of October 25, 2007.

Combined Agenda

  • Total Environmental Solutions, Inc., FUS-0852*, R-00072523.  Beech Mountain Lakes Sewer Division Home Office – Baton Rouge, LA  Supplement No. 4 to Tariff Wastewater – Pa. P.U.C. No. 3, filed July 16, 2007, to become effective January 1, 2008, proposing a general rate increase of $56,580.  Staff recommends that the Commission permit the Tariff to become effective on January 1, 2008, consistent with the proposed Order. 
  • Total Environmental Solutions, Inc., OTS-0024, R-00072523.  Supplement No. 4 to Tariff Wastewater – Pa. P.U.C. No. 3, to become effective January 1, 2008, proposing an annual increase in rates of $56,580.  Staff recommends that the Commission permit the Tariff to become effective January 1, 2008.  Adopt 4-0 to the extent that it is consistent with FUS-0852.

 Law Bureau

  • Philadelphia Gas Works, L-0098*, P-00072331.  Petition for Waiver of 52 Pa. Code §62.33.  Staff recommends that the Commission adopt the proposed Order that grants the waiver until February 1, 2008, on the condition that PGW provides status reports on the progress of the system upgrade on a quarterly basis until February 1, 2008.  Motion by Vice Chairman Cawley Moving that the petition be held in abeyance pending detailed replies to questions contained in his Motion and that the Law Bureau prepare and Order consistent with the Motion is attached.  Statement of Chairman Holland is attached.  Vote of 4-0 with no further discussion.
  • Advanced Notice of Proposed Rulemaking, L-0100 R*, L-00040168 regarding Small Generation Interconnection Standards and Procedures.  Staff recommends that the Commission adopt the proposed Order, to be published in the Pennsylvania Bulletin.  Postponed until Public Meeting of October 25, 2007.

 Office of Administrative Law Judge

  • Verizon North Inc. 2007 Price Change Opportunity Filing (PCO); OSBA v. Verizon North Inc. and Verizon PA Inc. 2007 Price Change Opportunity Filing; OSBA V. Verizon PA Inc., ALJ-0176*, R-00061914, P-00001854F1000, R-00061914C0001, R-00061915, P-00930715F1000, R-00061915C0001.  On November 1, 2006, Verizon PA Inc. filed its 2007 PCO pursuant to its Chapter 30 Plan. Under this filing, Verizon PA proposed an annual revenue increase and an actual price increase due to the proposed use relating to the banked increase from its 2006 PCO filing. The proposed rate increases were to be effective on January 1, 2007. Also on November 1, 2006, Verizon North Inc. filed its 2007 PCO pursuant to its Chapter 30 Plan. Under this filing, Verizon North proposed an annual revenue increase and an actual price increase due to a proposed banking of the 2007 PCO value. The proposed rate increases were to be effective on February 15, 2007.  A Joint Settlement Petition was filed on August 9, 2007.  Staff reviewed ALJ Melillo’s Recommended Decision approving the Settlement.  Concurring Statement of Vice Chairman Cawley is attached.  Chairman Holland also applauded the companies’ settlement and noted his appreciation of the compromises made by each party.  Vote of 4-0 with no further discussion.
