Highlights: PA PUC Public Session of January 10, 2008

At the January 10, 2008 Public Meeting of the Pennsylvania Public Utility Commission (“Commission”), the Commissioners adopted Staff’s recommendations for action by a vote of 4-0 on all items listed on the Main Agenda and Carry-In Agenda, except as reflected herein below under the respective Commission agenda headings.  Review of particular items addressed by the Commissioners at this Public Meeting which may be of interest are also addressed under the respective Commission agenda headings below.  Any relevant motions and statements are attached to the original of this Session Memo filed in the Public Meeting Agenda and Session Memo binder.  The next regular Public Meeting is tentatively scheduled for Thursday, January 24, 2008 at 10:00 a.m.  The minutes of the Public Meeting of December 6, 2007, were unanimously approved without modification.

Bureau of Transportation and Safety

  • All matters approved as submitted.

Office of Special Assistants

  • Cynthia Truesdell v. Columbia Gas of Pennsylvania, Inc., OSA-0002*, F-02118007.  On December 27, 2006, Complainant filed a Formal Complaint against Columbia alleging that she failed to receive a bill for gas during May, June and July 0f 2006, and the bill she ultimately received was inaccurate.  Columbia filed an Answer on January 23, 2007.  By Initial Decision issued on July 12, 2007, ALJ Hoyer dismissed the Complaint but imposed civil penalties on Columbia for violations of the Public Utility Code and the Commission’s Regulations.  Columbia filed Exceptions on August 15, 2007.  Staff recommends that the Commission adopt the proposed Opinion and Order denying Columbia’s Exceptions and adopting the ALJ’s Initial Decision.  This matter was postponed until Public Meeting of January 24, 2008.
  • The United Telephone Company of Pennsylvania d/b/a Embarq and DPI Teleconnect, LLC, OSA-0008*, A-310804F7002.  Joint Petition filed on November 21, 2007, for Approval of a Master Interconnection, Collocation and Resale Agreement.  Staff recommends that the Commission adopt the proposed Opinion and Order granting the Joint Petition.  Vote of 4-0 with no discussion.

Bureau of Fixed Utility Services

  • All matters approved as submitted.

Combined Bureau Agenda

  • Aqua Pennsylvania, Inc., Home Office - Bryn Mawr, PA, FUS-0801* R-00072711, R-00072711C0001, et al.  Supplement No. 82 to Tariff Water – Pa. P.U.C. No. 1, filed November 21, 2007, to become effective  January 21, 2008, proposing an annual increase in revenues of $41,700,000. Formal Complaints have been filed.  Staff recommends that the Commission institute an Investigation, noting that the filing will be suspended by operation of law until August 21, 2008; and that the case be assigned to the OALJ, consistent with the proposed Order.
  • Aqua Pennsylvania, Inc., OTS-0001 R-00072711.   Supplement No. 82 to Tariff Water – Pa. P.U.C. No. 1, to become effective January 21, 2008, proposing an annual increase in revenues of $41,700,000.  Staff recommends that the Commission institute an Investigation of the Tariff and allow the filing to be suspended by operation of law for a period of seven months, or through August 21, 2008.
  • Proposed Rulemaking to Amend 52 Pa.code Ch. 63,  (relating to Telephone Service) , L-0101*, TN-                          .  To Supplant Existing Policy Statement at 52 Pa. Code §§ 69.511 – 69.513 (relating to the Operation of the Telecommunications Relay Service System and Relay Service Fund).  Staff recommends that the Commission adopt the proposed Rulemaking Order, to be published in the Pennsylvania Bulletin.  This matter was postponed until public meeting of January 24, 2008.

ANNOUNCEMENTS

  •  It was noted that a Lobbyist from Duquesne Light Company had passed away, as well as Phil McClelland.  Phil’s obituary was entered into the Public Meeting Minutes.  Sonny Popowsky lead the Pledge of Allegiance in their honor to commemorate their passing.
