Highlights: PA PUC Public Session of February 28, 2008

At the February 28, 2008 Public Meeting of the Pennsylvania Public Utility Commission (“Commission”), the Commissioners adopted Staff’s recommendations for action by a vote of 4-0 on all items listed on the Main Agenda and Carry-In Agenda, except as reflected herein below under the respective Commission agenda headings.  Review of particular items addressed by the Commissioners at this Public Meeting which may be of interest are also addressed under the respective Commission agenda headings below.  Any relevant motions and statements are attached to the original of this Session Memo filed in the Public Meeting Agenda and Session Memo binder.  The next regular Public Meeting is tentatively scheduled for Thursday, March 13, 2008 at 10:00 a.m.  The minutes of the Public Meeting of January 24, 2008, were unanimously approved without modification.

Bureau of Transportation and Safety

  • All matters approved as submitted.

Bureau of Conservation, Economics and Energy Planning

  • All matters approved as submitted.

Office of Special Assistants

  • Nancy M. Dean v. PECO Energy Company (Billing Dispute), OSA-0018*, C-20077955.  Complainant alleged that her bills for electrical service incorrectly state the number of kilowatt hours used at Complainant's apartment.  On August 7, 2007, PECO filed an Answer and New Matter.  By Initial Decision issued on November 28, 2007, CALJ Smith granted the Preliminary Objections and dismissed the Complaint.  Complainant filed Exceptions on December 11, 2007.  Staff recommends that the Commission adopt the proposed Opinion and Order denying Complainant's Exceptions and adopting the CALJ's Initial Decision.  This matter has been postponed until Public Meeting of March 13, 2008.
  • Palmerton Telephone Company and RCN Telecommunications Services, Inc., OSA-0030*, A-2008-2019729.  Joint Petition filed on December 17, 2007, for Approval of an Interconnection Agreement.  Staff recommends that the Commission adopt the proposed Opinion and Order granting the Joint Petition.  Vote of 4-0 with no discussion.
  • Susan K. Pickford, et al v. Pennsylvania-American Water Company (Service issue), OSA-0084*, C-20078029 et al.  In September 2007, twenty-three Formal Complaints were filed by customers of PAWC, protesting PAWC's proposal to convert its West Shore Regional Water Treatment Plant and its Silver Springs Water Treatment Plant from chlorinated water to chloraminated water.  PAWC filed Preliminary Objections.  By her Initial Decision issued October 5, 2007, ALJ Chestnut granted PAWC's Preliminary Objections and dismissed the Complaints.  Various Exceptions were filed.  Reply Exceptions were filed by PAWC on November 5, 2007.  Staff recommends that the Commission adopt the proposed Opinion and Order that denies the Exceptions and adopts the ALJ's Initial Decision.  This matter has been postponed until Public Meeting of March 13, 2008.
  • Verizon North Inc. and CTSI, LLC, OSA-0092*, A-311095F7001.  Joint Petition filed on December 20, 2007, for Approval of an Interconnection Agreement.  Staff recommends that the Commission adopt the proposed Opinion and Order granting the Joint Petition.  Vote of 4-0 with no discussion.
  • Cecillia Susanto v. Verizon Pennsylvania Inc. (Billing Dispute), OSA-0094*, F-01985778.  On January 17, 2006, Complainant filed a Formal Complaint against Verizon PA alleging that she was overbilled for telecommunications services and that she experienced considerable difficulty proving her continued eligibility for Lifeline Service.  On February 13, 2006, Verizon PA filed an Answer.  By Initial Decision issued on September 20, 2006, ALJ Jones sustained the Complaint.  Complainant filed Exceptions on October 24, 2006, and Verizon PA filed Replies to the Exceptions on November 13, 2006.  Staff recommends that the Commission grant the Complainant's Exceptions in part and deny them in part, consistent with the proposed Opinion and Order.  Motion of Commissioner Pizzingrilli is attached.  Vote of 4-0 with no further discussion.
  • Ironton Telephone Company and RCN Telecom Services, Inc., OSA-0096*, A-2008-2019813.  Joint Petition filed on January 4, 2008 for Approval of an Interconnection Agreement.  Staff recommends that the Commission adopt the proposed Opinion and Order granting the Joint Petition.  Vote of 4-0 with no discussion.
  • County of Pike, et al v. Pike County Light & Power Company (PCL& P), OSA-0100*, C-20069542, et al.  Exceptions to ALJ Jandebeur's October 5, 2007 Recommended Decision, approving the Joint Petition for Settlement, were filed by PCL&P and OSBA.  Reply Exceptions were filed by OCA and the County of Pike.  Staff recommends that the Commission adopt the proposed Opinion and Order granting in part, and denying in part, the Parties' Exceptions; approving the Settlement and modifying the ALJ's Recommended Decision.  Motion by Commissioner Christy is attached, as well as the Statement by Vice Chairman Cawley.  Vote of 3-1 with Chairman Holland concurring in part and dissenting in part.

Bureau of Fixed Utility Services

  • The Newtown Artesian Water Company, 2021286-FUS-0006, P-2008-2021286.  Petition filed December 21, 2007 for permission to use deferred cost accounting and amortization in respect to certain well development costs.  Staff recommends that the Commission adopt the proposed Order.  Vote of 4-0 with no discussion.
  • Pennsylvania Power Company, 2013283-FUS-0004, S-20082013283.  Securities Certificate filed December 27, 2007, for the issuance and sale of up to $100 million aggregate principal amount of indebtedness in unsecured notes, mortgage bonds, and/or collateralized notes.  On January 18, 2008, Penn Power filed to extend the consideration period until February 29, 2008.  Staff recommends that the Commission adopt the proposed Order.  This matter has been withdrawn by the Bureau of Fixed Utility Services.

Combined Bureau Agenda

  • Ironton Telephone Company, 1190607-FUS-0013, P-00971182F1000.  2008 Price Stability Index/Service Price Index Filing filed February 1, 2008.  Staff recommends that the Commission approve the filing, consistent with the proposed Order.  Vote of 4-0 with no discussion.
  • Ironton Telephone Company, L-0007*, P-00971182F1000, P-2008-2022872.  Petition for Protective Order regarding its 2008 Price Stability Index and Service Price Index Report.  Staff recommends that the Commission grant the Petition in part and deny it in part, consistent with the proposed Order.

CARRY-IN AGENDA

Bureau of Fixed Utility Services

  • Wellsboro Electric Company, 2020257-FUS-0005, P-2008-2020257.  Petition, filed January 30, 2008, for Waiver of Interim Filing Requirement and for Recovery of Non-recurring Congestion Costs over None-Month Period.  Staff recommends that the Commission grant the Petition in part and deny it in part, as modified by the Comments of the Parties; and that the matter be referred to the OALJ, consistent with the proposed Order.  Joint Statement by Vice Chairman Cawley and Commissioner Pizzingrilli is attached, as well as the Statement by Commissioner Christy.  Vote of 4-0 with no further discussion.

ANNOUNCEMENTS

  • Two Egyptian Commission Interns were recognized by the Commissioners and the audience with a welcoming applause.
  • A celebration of Black History Month is taking place at the Forum at noon today.
  • Chairman Holland recognized and applauded Jeff Osmon's efforts and work as the President and CEO of York Water Company and wished him well in his upcoming retirement.
