PA PUC: Commission Adopts Final Rulemaking Order Regarding Retail Electric Choice Activity Reports

On December 4, 2008, the Pennsylvania Public Utility Commission (“Commission”) adopted a final rulemaking order that adopts reporting requirements regarding electric generation market activity to prevent anticompetitive or discriminatory conduct and the unlawful exercise of market power.
Sections 54.201 through 54.204 of the Commission’s regulations, 52 Pa. Code §§ 54.201-54.204, require each electric distribution company (“EDC”) and active electric generation supplier (“EGS”) to report sales activity information. An EDC must file quarterly reports indicating customer class as defined in its tariff. An EGS must file an annual report indicating customer groups defined by annual usage.
The Commission uses the reported sales activity information to monitor the retail electric generation market to prevent market power abuse and discriminatory conduct. The information is also used to conduct milestone reviews of the development of the retail market for generation. See 66 Pa.C.S. § 2804(12).
